With respect to this narrative, there are two interesting elements that stand out. But after awhile, an event takes place that causes these cynical goofballs to reassess their own responsibilities towards the furtherance of social justice. Ultimately she hires a ragtag collection of wiseacre college students to play in her film, and this is where the comedy elements enter into the picture. However, since the woman is unable to secure commercial funding for her filmmaking efforts, she goes to India on her own to see if she can recruit some nonprofessional actors to act in her movie. The woman was inspired to make this film after reading the diary of her grandfather, who was a British prison official in India and oversaw the executions of some of these freedom fighters. The story of the film is about a young English woman’s (Sue McKinley’s) efforts to shoot her own historical docudrama about heroic acts of patriotism on the part of some young Indian activists seeking Indian independence from Britain in the 1920s. Indeed there are some interesting features of this film that contribute to its popularity but there are also some problematic issues, which I will discuss below. It featured a top cast of performers, headed by popular actor Aamir Khan. Based on a story by Kamlesh Pandey, the film was directed by Rakeysh Omprakash Mehra and co-scripted by Mehra, Pandey, and Rensil D'Silva. Meanwhile, on the work front, Rakeysh Omprakash Mehra is best known for helming films like 'Delhi-6', 'Rang De Basanti', 'Bhaag Milkha Bhaag' and most recently 'Toofan'.Rang De Basanti (literally “Color it Spring”, i.e color it with the hues of spring (saffron) – 2006) is an Indian comedy/drama that has achieved great popularity, due in part to its invocation of Indian patriotism via mainstream Bollywood cinematics. The filmmaker further stressed that the entire dispute is civil in nature and stated that 'the intention to prosecute is to gain unwanted publicity by misuse of police and judicial machineries'. He also alleged that the script discussed by the writer was neither copyright protected, nor was it published. While stating that there is no copyright for an idea, in his application, he also made an argument that under Copyright Act, there is no bar to producing identical results by using the same idea.

He argued that the story of 'Rang De Basanti' is original and different from the script of 'Inquilab'. During the course of the hearing, Rakeysh moved an application for discharge on the ground that no offence is made to the issue process. Now, while relying upon the order of the Sessions court, the Magistrate court observed that the present proceeding by a Sessions court was binding on the lower court. Notably, writer Mustaq Mohsin approached the court, claiming that he had discussed a script titled 'Inquilab' with the filmmaker but Mehra used the same script for his film 'Rang de Basanti', which was released in the year 2006.

The sessions court had observed that the 'criminal proceeding itself was not tenable as the story 'Inquilab' was not registered' and that there was no 'prima facie material to prove the offenses punishable under the Copyright Act'. He had moved the Sessions court which had set aside the Magistrate court order of issuing process. Earlier, in the case, the session court gave relief to the producer of the film Ronnie Screwala. While giving relief to the ace filmmaker Rakeysh Omprakash Mehra in the film 'Rang De Basanti' copyright infringement case, the Aurangabad court has acquitted him from all the charges made by a writer and accused him and the makers of the film of plagiarism.
